4. Limitation of Liability

All calculations are based on the values entered by the user and on general average values. Actual costs, consumption values, prices, and subsidies may differ based on individual conditions (see also Section 3 regarding the non-advisory nature of this service).

The operator is a private individual providing EVSpend free of charge. Liability for the accuracy, completeness, or timeliness of calculations is excluded to the extent permitted by law. Statutory liability for intent and gross negligence, as well as for damages arising from injury to life, body, or health, remains unaffected.

Before making economically significant decisions (in particular vehicle purchase, long-term financing commitments, investments in charging infrastructure), independent verification of the calculation results is recommended.

5. Use

Use of this website is at the user's own risk. The operator shall not be liable for damages arising from the use or inability to use the information provided. The user is responsible for verifying any information before relying on it for personal or financial decisions.

6. Affiliate Links

8. Jurisdiction and Applicable Law

These terms of use and the use of EVSpend are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with habitual residence in another EU member state, the mandatory consumer protection provisions of their home country remain unaffected.

The place of jurisdiction for all disputes arising from or in connection with the use of EVSpend is, to the extent permitted by law, the residence of the operator (Stadtallendorf, Germany). For consumers, the statutory place of jurisdiction applies, which is generally the consumer's residence.

If any provision of these terms of use is invalid, the validity of the remaining provisions remains unaffected.

9. Consumer Rights in the EU

As a consumer in the European Union, you have mandatory consumer protection rights under EU law that cannot be waived by these Terms. These include:

  • Right to clear and accurate information
  • Protection against unfair contract terms (Directive 93/13/EEC)
  • Right to withdrawal for distance contracts (where applicable)

Should any provision of these Terms conflict with mandatory EU consumer protection law, the EU law shall prevail.
